1. Scope

These General Terms and Conditions apply to all orders placed via our online shop or telephone enquiries. Our online shop is primarily aimed at consumers, but also at business customers in some cases.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

2. Contractual partner/conclusion

The purchase contract is concluded with ‘WINETORY, Wolfgang Angeli’, the operator of the online shop winetory.de.

  • Online order: The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You first place our products in your shopping basket without obligation. Then you maintain and correct all entries before submitting your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you submit a binding order for the goods contained in the shopping basket. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.
  • Offer: Only an official offer from our merchandise management system constitutes a legally binding offer.

We accept your order by sending a declaration of acceptance in a separate email within two working days or by dispatching the goods.

3. Contract language/text storage

The languages available for concluding the contract are German or English.

We will store the contract text and send you the order details and our terms and conditions by email. You can also view the contract text in your customer account or online.

4. Delivery conditions

In addition to the product prices quoted, shipping costs may also apply in some cases. You can find more detailed information on any shipping costs that may apply in the offers. We also ship some items free of charge.

We only deliver by post. However, it is possible to collect the goods yourself on request.

5. Payment

The following payment methods are generally available in our shop:

  • Credit card: With Shopify Payments, the shop can accept all major credit cards. If you select credit card as your payment method, the following are currently accepted: VISA, Mastercard, Maestro or American Express.
  • Wallets: Shopify Payments accepts payments via digital wallets to increase conversion on mobile devices, including Google Pay and Apple Pay.
  • Prepayment/bank transfer: If you select prepayment or bank transfer as your payment method, we will send you our bank details in a separate email and will only dispatch the goods after receipt of payment.
  • Cash payment: Cash payment is only possible when collecting goods in person.
  • PayPal, PayPal Express: During the ordering process, we will redirect you to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or first register, then authenticate with your access data and confirm the payment instruction to us. After placing your order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further information during the ordering process.
  • PayPal Plus: As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. We will redirect you to the website of the online provider PayPal. There you enter your payment details, accept the use of your data by PayPal and confirm the payment instruction to PayPal.
    • Credit card (with PayPal Plus): If you choose to pay by credit card, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your authentication as the legitimate cardholder by your credit card company at the request of PayPal, and your card will be charged. You will receive further information during the ordering process.
    • Purchase on account (with PayPal Plus): If you have chosen the invoice payment method, you do not need to be registered with PayPal to pay the invoice amount. After successful address and credit checks and submission of the order, we assign our claim to PayPal. In this case, you can only make payment to PayPal with debt-discharging effect. In addition to our terms and conditions, PayPal's terms and conditions and privacy policy apply to payment processing via PayPal. 6. Retention of title

The goods remain our property until full payment has been received.

7. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or transport insurance company.

8. Warranty & guarantees

The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

9. Accessibility

In accordance with the statutory provisions, our company is exempt from the scope of accessibility requirements and thus from the obligation to create and provide an accessibility statement.

10. Protection of minors

If your order includes goods whose sale is subject to age restrictions, we use a reliable procedure involving a personal identity or age check to ensure that the customer has reached the required minimum age. The delivery person will only hand over the goods after checking the age and only to the person who placed the order. If there is any doubt, delivery persons are instructed to ask for proof of age by showing an identity card.
